I think the bailiff made the seizure unfairly, what can/should I do now?
Report this to Modero immediately. In some cases, the attachment can be revised or rectified. The faster you respond, the greater the chance of a solution. Here is the full list of goods that should never be confiscated: https://www.gerechtsdeurwaarders.be/de-gerechtsdeurwaarder/praktische-informatie/niet-voor-beslag-vatbare-goederen.
Within what period of time do you file an objection?
You must file your objection at the time of attachment, or at the latest 15 days after service of the attachment pilot, pass it on to us. We deliver this to the appellate judge along with the inventory and the planned sale date. The judge then makes a ruling; he is not subject to opposition or appeal.
Attention: goods from a partner or roommate
When a bailiff seizes, he assumes that all the goods in your home are also yours. If you live together, your roommate's property can therefore also be seized, even if they have nothing to do with your fault. Partners or roommates can challenge this in court via a revindication procedure. Legal assistance is recommended.
Not sure what seizure or revindication means? You can find the answer in our section something misunderstood.
Tip: if you have any doubts or questions, contact Modero. Together, we will look for a solution and see what steps are possible.
